General Terms and Conditions of Sale

The general terms and conditions govern the remote purchase of products or services on the website www.flashpointlearning.it owned by Flashpoint Learning Srl, an Italian company with registered office at Via Norvegia, 56 – 56021 Cascina (PI) (Italy), registered with the Pisa Chamber of Commerce under no. 173664, Tax Code/VAT no. 01505620490.
Flashpoint Learning sells on the aforementioned website, in particular, services (synchronous or asynchronous training courses, participation in seminars and events, consultancy services) and products (books, applications and multimedia supports) as further detailed on the website and in the various subpages that describe them accurately, specifying their content and methods of use.

The services and products (hereinafter also referred to as “items”) are offered to users who may be consumers or non-consumers. Consumers are considered those who purchase products or services for purposes unrelated to their entrepreneurial or professional activity in accordance with Legislative Decree 206/2005 (Consumer Code). All those who, at the time of purchase, provide a VAT number or other equivalent tax information referring to their entrepreneurial or professional activity are not considered consumers.

The ADR volume and the RID volume, both in their current editions, translated into Italian by Flashpoint S.r.l. through Dr. G. Scibilia, are included, individually or occasionally together, in the training material delivered to participants during training courses, events, etc., organized online or in person by Flashpoint Learning Srl or by third parties. The two volumes may also be used as training material by all those involved in workplace safety and in the transport of dangerous goods by road and/or rail.

The General Terms and Conditions of Sale may be periodically updated; those published on www.flashpointlearning.it and accepted at the time of purchase on the website shall be deemed effective and binding.
Please read the terms and conditions of sale carefully before proceeding with the purchase.

Purchase Procedure and Conclusion of the Sales Contract

Purchase Procedure and Conclusion of the Sales Contract For each training course, a detailed description and the key features are displayed: the objective, target audience, duration, dates, method of delivery, locations if applicable, the
program, and the unit price.

In the descriptive sheet, the user can view the available course options and select the date, method, type, and location of interest and the number of available participants. To proceed with the purchase, the user must, after selecting the date of the course they wish to purchase, click the “Add to cart” button, view the total cost summary at the top right of the page in the cart section which is automatically updated based on their selection, click the “cart” icon to proceed to the “Cart” summary page. Here they will find a summary of the selected courses and the total price excluding and including VAT. At this point, the user can choose to return to shopping to add more items to the cart or proceed with the purchase by clicking the “Checkout” button: they will be asked to enter login credentials, if already in possession, or to register to obtain them (“Register and enter billing
information”).

Once logged in, the user can choose a payment method from the following: bank transfer, PayPal account, credit card via PayPal module. The user can then proceed to confirm the order by selecting the “Checkout” button.
If, at the time of the order, registrations for the selected course are closed, the note “not available” will be displayed and the user will not be able to proceed with the purchase.

For each product/publication, a descriptive sheet, the item description, and the unit price are displayed. The visual representation of the products on the site generally corresponds to the photographic image of the same and is intended solely to present them for sale: the images and colors of the products represented may not correspond to the actual ones, especially with regard to size and/or color aspects of covers and/or packaging.
In the descriptive sheet of each product, the user can view the complete description, select the desired quantity, and check availability. To proceed with the purchase, the user must: click the “Add to cart” button, view the total cost summary at the top right of the page in the cart section which is automatically updated based on their selection, click the “cart” button to proceed to the “Cart” summary page. Here they will find a summary of the selected products and the total price excluding and including VAT. At this point, the user can choose to return to shopping to add more items to the cart or proceed with the purchase by clicking the “Checkout” button: they will be asked to enter login credentials, if already in possession, or to register to obtain them (“Register and enter billing information”).

Once logged in, the user can choose a payment method from the following: bank transfer, PayPal account, credit card via PayPal module ( Tutorial for purchasing with credit card via PayPal module ). The user can then proceed to confirm the order by selecting the
“Checkout” button.
If, at the time of the order, the selected product is not available, the note “not available” will be displayed and the user will not be able to proceed with the purchase.

Upon receiving the order, Flashpoint Learning will automatically send the user an email confirming receipt containing a summary of the order and all details relating to the purchase, i.e., the type of item requested and related costs, as well as the user's personal and contact information. In case of payment by bank transfer, the user will receive an email containing the instructions for making the transfer (Flashpoint Learning's details, banking information, and the Bank's address).

The sales contract shall be considered concluded at the moment Flashpoint Learning receives the payment.

Each sales contract will be electronically stored by Flashpoint Learning via WooCommerce, the e-commerce plug-in of WordPress on which the site is built, and will be visible both to Flashpoint Learning staff and to the operational personnel of the external service provider managing the webmastering.

During the course (whether in classroom, online, video course, or any other type of event made available by Flashpoint Learning, whether free or paid), it is prohibited to take photographs and/or make any type of audio or video recording.

Data Entry

The user is required to provide valid data.

Flashpoint Learning is not responsible for the non-delivery of products due to incorrect postal address information provided by the user at the time of purchase.
Flashpoint Learning is not responsible for incorrect invoicing resulting from inaccurate fiscal or personal data provided by the user at the time of purchase.
The user is responsible for the accuracy of the participant data submitted to Flashpoint Learning, via email or Excel file provided on the course page, for the activation of e- learning courses on partner platforms such as AiFOS.

During the site registration phase and upon subsequent access, the user can view and manage their personal data on the “My Account” page: order history and details, course participant data, addresses and personal information, and any vouchers.
The user may modify their personal, fiscal, and address data at any time: for invoicing and product delivery purposes, the data entered/present at the time of purchase shall be considered valid.
The user may notify any changes concerning participant names by emailing info@flashpointlearning.it at least 2 days prior to the course date for online courses, 5 days prior for classroom courses, and at least 1 day before first access to the learning platform (AiFOS and/or Conformity) in the case of asynchronous e-learning courses.

NOTE FOR E-LEARNING COURSES (asynchronous courses or video courses)

The e-learning courses available on this site are delivered via a dedicated platform (AiFOS and/or Conformity). Upon completing the purchase order of an e-learning course, the customer must correctly fill out the Excel file for Participant Data Collection and send it by email to info@flashpointlearning.it .
The Participant Data Collection Excel file is required to enable the Flashpoint Learning staff to create a personal account for each participant on the learning platforms and to send access credentials accordingly.
Access credentials for the e-learning course platforms will be sent within 72 hours of payment receipt.

Issuance of ECM Credits for Professional Chemists

Flashpoint Learning ECM courses grant 1.5 credits per hour of synchronous online training and 1 credit per hour of in-person training. ECM credits for professional chemists are issued only for specific Flashpoint Learning training courses; the customer must ensure that they request credits only for courses marked with the ECM label.

What are the conditions for the issuance of ECM credits?

  • Register for the ECM course at least 15 days before the course start date.
  • To be confirmed, the course must reach the minimum number of participants (a necessary condition for all our courses, including non-ECM).
  • A confirmed course will issue ECM credits for CHEMISTS only upon reaching a minimum number of credit requests. Note: Confirmation of both the ECM credit issuance and the course itself will be communicated to the professional chemist before the course begins.

How to request ECM credits?

  1. Proceed with the purchase of the selected course as usual: choose the course date and add it to the cart.
  2. When entering participant data, check the box “I request ECM credits” in the Participant Information section. Subsequently, declare whether you have been recruited by companies to attend the course (information required by Agenas).

Price and Payment Terms

The price of each item is expressed in Euro (€).
The price is indicated for each item on the relevant description page, net of applicable taxes (VAT according to current regulations), and both net and gross of such taxes on the cart summary page.
The displayed price of the ADR Volume, RID Volume, and in general of printed publications includes 4% VAT.
The displayed price of digital publications is shown net of taxes (VAT according to current regulations, 4%).

Flashpoint Learning Srl reserves the right to change at any time and without prior notice the type of items offered (adding new courses and/or products, removing courses and/or products, modifying course locations and dates, and modifying course programs) and their price (price increases or reductions also due to special promotions). The conditions presented at the time of the user’s purchase will remain unchanged.

  • Payment is required in advance for all products and items for sale on this website and can be made using one of the following methods: Bank transfer payable to Flashpoint Learning Srl, Via Norvegia, 56, 56021 Cascina (PI);
    Bank details: Intesa Sanpaolo S.p.A., Pisa Branch, Corso Italia, 2;
    IBAN: IT57O0306914010100000003805
    Prepaid PayPal account for users who have one;
  • Credit card (VISA, Visa Electron, MasterCard, Carta Aura, American Express, Postepay, Discover) via the PayPal module.

INVOICING

The invoice for the purchase of one or more training courses and/or publications will be sent to the SDI (Italian Interchange System) and to the email address provided by the user at the time of registration on the website within 12 days of payment. Flashpoint Learning does not issue invoices before payment of the purchased service/course/product.
Before completing the order, the user is required to enter the internal company purchase order number to be included on the invoice in the notes field on the cart summary page.
The user may also communicate the internal company order number to be included in the invoice at the time of payment.
Flashpoint Learning is not responsible for incorrect invoicing due to inaccuracies in the tax and personal data entered by the user at the time of purchase and not communicated in a timely manner to the addresses info@flashpointlearning.it or amministrazione@flashpointlearning.it .

Shipping Methods and Costs, Returns

Shipping Costs
Shipping methods and related costs are indicated during the user's online purchase
process.

Shipping costs are normally borne by the user and are therefore added to the product price, except in cases of special promotions where such costs may be reduced or free of charge: in such cases, express notice is given to the user during the purchase process.
Shipping costs are calculated based on the weight (expressed in kilograms) of the product, according to the courier's pricing list used. These costs are always indicated on the product page.
All shipments within Italian territory will be delivered by courier between 9:00 a.m. and 5:00 p.m., Monday to Friday, excluding public holidays.
Shipments to P.O. boxes are not available.
Once the products are handed over to the courier, it will no longer be possible to change the user’s shipping address.

Delivery Times
The delivery time for products is 10 business days from receipt of payment. Any delivery
delays must be reported via email to Customer Service ( info@flashpointlearning.it ) no
later than 60 calendar days from the date of purchase.
Flashpoint Learning undertakes to ensure delivery of the goods to the user within 15 days
from receipt of the above-mentioned report.
The customer is required to provide a valid delivery address accessible during delivery
hours (see “Data Entry” section).

Receipt of Goods
The courier requires the recipient’s signature “for receipt” at the time of delivery; without a signature, the goods will not be delivered, and Flashpoint Learning will not be obliged to refund the amount paid at the time of purchase or to arrange a second shipment.
If the recipient is not available, the courier will leave a notice slip at the specified postal address, and it will be the user’s responsibility to follow the instructions on the slip to collect the goods.

Returns
The user must open the package in the presence of the courier in order to check the integrity of the product(s).
If, upon opening the package, the user detects any discrepancies between the order and what was received, and in particular finds any issues regarding physical integrity, accuracy, or completeness of the products received, any anomalies must be noted in writing on the delivery slip: in the absence of such notes, the goods shall be deemed delivered in perfect condition.
The same anomalies must be reported within 2 days of opening the package to Customer Service ( info@flashpointlearning.it ). Flashpoint Learning will arrange for a new shipment of the goods within 15 days from receipt of the email.
In no case will the user be required to return defective or mistakenly shipped items at their own expense.

Withdrawal
Customer’s Right of Withdrawal
Pursuant to Articles 64 et seq. of the Consumer Code, the Consumer has the right to withdraw from the purchase without any penalty and without specifying the reason. To this end, the user must notify Flashpoint Learning Customer Service via email ( info@flashpointlearning.it ) or by fax according to the following terms:

  • Courses/seminars/events: within 7 calendar days from the date of the event.
  • Products: no later than the delivery of the goods to the user and in any case within 7 calendar days from the purchase date.

The user is entitled to receive a full refund of the amount paid or, in the case of a course purchase, to use the amount at their discretion to attend a course scheduled at a later date, only and exclusively if the intention to exercise the right of withdrawal has been communicated within 7 calendar days from the date of the course/seminar/event. If the right of withdrawal is not exercised within the aforementioned timeframe, the paid amount CANNOT be refunded or applied to another course or session.

The user is not entitled to withdraw from sales contracts for products that are immediately downloadable from the Site, such as software, applications, e-books, nor in cases where seals placed on software products have been broken.

Returned products subject to withdrawal must be shipped, at the user's own expense and responsibility, via a courier of their choice, to the following address:

To validly exercise the right of withdrawal, the user must comply with the following
conditions and procedures:

  • The withdrawal may also be applied only to individual products within a single sales contract, provided that the user may not exercise the right of withdrawal for only part of a single purchased product.
  • All products for which the user has exercised the right of withdrawal must be returned intact, with original packaging complete in all its parts, including packaging materials, any seals applied, and any accompanying documentation.
  • If the product subject to withdrawal arrives damaged at Flashpoint Learning, the company will only be obliged to notify the user to allow them, if possible, to exercise the right of recourse against the chosen courier for the product return.
  • Flashpoint Learning shall not be liable in any case for damage, theft, or loss of returned products until they are received. All risk shall be borne exclusively by the user.
  • Once the integrity of the returned product has been verified, Flashpoint Learning will refund the user the full amount paid for the products covered by the sales contract subject to withdrawal, within and no later than 30 days from receipt. The refund will be made using the credit card details provided by the user at the time of the order, or via PayPal for users who have an account, or by bank transfer to the bank account details provided by the user.

If the user violates, in whole or in part, the provisions regarding withdrawal set forth in these General Conditions, the sales contract shall remain valid and effective, and Flashpoint Learning will return the improperly returned products to the user, charging them
the relevant shipping costs.

Right of Withdrawal of Flashpoint Learning Srl
Flashpoint Learning reserves the right not to accept any orders from users who have engaged in irregular conduct, are suspected of unlawful behavior, or are subject to a judicial order.

Flashpoint Learning is entitled to withdraw from any Sales Contract concluded with the user by giving written notice via email or fax, under the terms set out below:

  • Courses/seminars/events: activation takes place upon reaching a minimum number of participants, which varies depending on the type of course/event/seminar. If the minimum number is not reached, Flashpoint Learning Srl may, with at least 2 working days’ notice before the scheduled date, postpone or cancel the course/event/seminar by providing written communication (via email or fax) to the user and, where possible, also verbally. The amount already paid will be refunded within 30 calendar days or, at the user’s discretion, applied as full or partial payment toward a course/event/seminar scheduled on a later date.
  • Products: Flashpoint Learning may cancel the delivery of purchased goods within
    and no later than 5 calendar days from the purchase date, providing written
    communication (via email or fax) to the user and, where possible, also verbally.

The refund will be made using the credit card details provided by the user at the time of the order, or via PayPal for users who have an account, or by bank transfer to the bank account details provided by the user.

Communications and Complaints
All communications or any complaints addressed to Flashpoint Learning must be sent to the Flashpoint Learning Customer Service by email at info@flashpointlearning.it or by registered letter with return receipt addressed to Flashpoint Learning Srl, Via Norvegia, 56, 56021 Cascina (PI), Italy.

Disputes
For any dispute, the competent court shall be the Court of Pisa or that of the Consumer’s place of residence.
Before taking legal action, Flashpoint Learning encourages its customers to participate in an attempt at amicable resolution, which the user may initiate online at www.risolvionline.it .
Flashpoint Learning will guarantee its participation.
Risolvionline.it is an institutional service provided by the Arbitration Chamber of the Milan Chamber of Commerce, through which parties can seek to reach a mutually satisfactory agreement following a dispute.
